Describing a Disability During a Hearing

It goes without saying that a claimant’s disability pervades his or her life and is not easily suppressed – even for a benefits disability hearing. Many chronic injuries and disabilities come in waves and an individual can experience good days and bad days. This highly personal matter is also highly relevant in determining disability benefits, and a claimant enduring a benefits hearing should be prepared to discuss the ratio of good days to bad throughout the course of a typical month. Claimants must also describe a good or bad day and what each entails in terms of mobility and functionality. Some judges will inquire as to an actual number of good days versus bad days during the course of one month, and a well-prepared claimant will arrive at the hearing with these figures firmly memorized.

It is also important to be very detailed when explaining a good day or bad day. Be sure to specifically describe any physical or mental limitations inherent in a bad day and how this will affect the ability to work. Equally important is to avoid the urge to exaggerate symptoms or minimize abilities. Social Security judges are very experienced in handling these cases and will likely sense if testimony is stretched beyond the limits of truthfulness. An experienced Indiana disability lawyer will help you prepare for your hearing but be aware that your testimony must be in your own words and based upon your own perceptions.
